I agree that in the case of a penguins ability to fly the use of the word is generally speaking inappropriate albeit not impossible. That doesnt mean however that ability has nothing to do with freedom. Check again my answer 43. Even ability is a matter of interpretation, and can even be a basis of exploitation/oppression.
